Subrogation

Unless you have been involved in an accident where your health or auto insurer was reimbursed for payments it made, you probably do not know what a subrogation claim is — but here is why you should.

Black’s Law Dictionary defines subrogation as “the substitution of one person in the place of another with reference to a lawful claim, demand or right, so that he who is substituted succeeds to the rights of the other in relation to the debt or claim, and its rights, remedies and securities.” In practical terms, this means that when your involved in an accident and your health insurance company, or Medicaid, Medicare, etc. pays for your accident related medical bills, they get to seek reimbursement out of your personal injury settlement.

Settlements can be reached with these providers as part of the claims and settlement process. Each case is different. Due to the complexities of medical causation, limits on insurance, the clarity or lack thereof of the language of the health plan’s contractual and or legal claims, compromised and equitable reimbursements are obtainable during the settlement process.
